The Legal Loophole Behind Sweepstakes
Hi all! I am mostly through my college applications so will work on getting out more consistent articles.
An interesting aspect of United States gambling laws are its rules on sweepstakes. While online gambling is significantly restricted, offering “sweepstakes”, which is basically a lottery, is allowed. Sweepstakes tickets are not allowed to be sold directly, because that would be gambling. However, you are allowed to award “free” tickets upon purchase of a product, regardless of what that product actually is. You might be saying this is like a teenager paying an adult at the gas station to buy them beer, and you would be right. You can dress up the methods however you like, but the end result is still a lottery.
That being said, companies are legally required to offer free entries to their sweepstakes, so they can keep the veneer of not allowing participants to pay for entry.
